SB 1241, retroactive to January 1, 2009, allows the Director of the Arizona Department of Water Resources to exclude certain withdrawn groundwater when calculating a water storer’s long-term storage credit.

Summary of the Proposed Strike-Everything Amendment to SB 1241

The proposed strike-everything amendment to SB 1241 modifies the penalties for exceeding expenditure limitations for the Town of Superior.



Article IX, Sections 20 and 21 of the Constitution of Arizona prescribes expenditure limitations for each county, city or town to be determined by the Economic Estimates Commission (Commission). The Commission is established in Article IX, Section 17 of the Arizona Constitution and is composed of no more than three members serving two year terms. Pursuant to Arizona Revised Statutes (A.R.S.) § 41-561, the Commission is comprised of the Director of the Department of Revenue, who must serve as chairman, and two persons knowledgeable in the field of economics, one being appointed by the Speaker of the House of Representatives and the other by the President of the Senate.

Pursuant to A.R.S. § 41-563, if the governing board of a political subdivision authorizes expenditures in excess of the expenditure limitation, the expenditure limitation for that political subdivision for the following fiscal year must be reduced by the amount of expenditures in excess of the limitation, unless the governing board has held an election and the excess expenditure has been approved by a majority of the qualified electors.


·          Specifies the penalties for excess expenditures of local revenues by the town of Superior for fiscal year 2007-2008 must equal $100.

·          Contains a retroactivity date of July 1, 2010.
