    As Transmitted to the Governor

HB 2081 continues the Arizona Department of Water Resources (ADWR) for an additional ten years.

    History

The passage of the Groundwater Management Act in 1980 established the Department of Water Resources to manage, monitor, plan and regulate water quantity in the state.  To this end, ADWR administers and enforces Arizona’s Groundwater Management Code and certain surface water rights laws, negotiates with external political entities to protect Arizona's Colorado River water supply, oversees the use of surface and groundwater resources under state jurisdiction, and represents Arizona in discussions of water rights with the federal government.

In addition, ADWR operates flood warning and dam safety programs, provides administrative and technical assistance to the State Superior Court with regards to water adjudications and has provided staff support to the Arizona Water Banking Authority since its creation in 1996.

The Senate Natural Resources, Infrastructure and Public Debt and House of Representatives Water and Energy Committee of Reference met on October 28, 2009 and recommended that ADWR be continued for ten years.

    Provisions

    ·          Extends the termination of ADWR to July 1, 2020 and repeals the statutes related to ADWR on January 1, 2021.

    ·          Contains a Purpose clause.

    ·          Contains a Retroactivity clause.
