    SUBJECT:      Strike everything amendment to H.B. 2188, relating to veterans’ cemeteries; state trust lands

    Purpose

     

                Establishes a process for the State Land Department to reassign state trust lands among designated trust beneficiaries.  Requires the State Land Commissioner to make parcels of trust land available for use as veterans’ cemeteries and outlines conditions for conveyance of the land.

     

    Background

     

    Congress passed the Arizona-New Mexico Enabling Act in 1910, which authorized the Territory of Arizona to form a state government.  The Enabling Act included a provision that set aside certain land to be held in trust and managed in a way to support specific beneficiaries, including schools, legislative, executive, and judicial buildings and several other public institutions.  Approximately 9.3 million acres of state trust land are currently managed by the Arizona State Land Department (SLD). 

     

    Trust land may be disposed of only as allowed by the Arizona State Constitution (Constitution) and the Enabling Act.

     

    The Selection Board (Board) is composed of the Governor, the State Treasurer exercising powers as Surveyor-General and the Attorney General. The Boards responsibilities include overseeing the designation of trust lands (A.R.S. § 37-202).

     

    The Arizona Department of Veterans Services (DVS) was established to assist veterans and their families and dependants in presenting, providing and establishing claims, privileges, rights and benefits that veterans have under federal, state or local law.

     

    Statute allows DVS to acquire property for and to establish and operate veterans’ cemeteries (A.R.S. § 41-603).

     

    There is no anticipated fiscal impact to the state General Fund associated with this measure; however there are costs associated with the redesignation and conveyance of trust lands and with the maintenance of veterans’ cemeteries.

     


    Provisions

     

    Trust lands for veterans’ cemeteries

     

    1.      Requires the State Land Commissioner (Commissioner) to make parcels of trust land located in urbanized areas available for conveyance to DVS for use as veterans’ cemeteries.

     

    2.      Requires, before trust lands can be conveyed, DVS or another veterans service agency to apply to the Commissioner for conveyance of land and requires DVS or other veterans service agency to agree to pay the costs associated with the conveyance of trust lands.

     

    3.      Limits lands subject to conveyance for use as veterans’ cemeteries to four parcels of up to 250 acres.

     

    4.      Stipulates that each parcel must be selected from lands held in trust for legislative, executive and judicial public buildings.

     

    5.      Requires a conveyance to provide for the perpetual use of the lands as a cemetery for veterans.

     

    6.      Stipulates that if lands are not put into use as veterans’ cemeteries within five years of conveyance DVS may apply for a court order reverting the land to the SLD.

     

    7.      Specifies that lands conveyed for use as veterans’ cemeteries that revert to the SLD are to be held in trust for the benefit of legislative, executive and judicial public buildings.

     

    Reallocation of trust land

     

    8.      Authorizes the Selection Board (Board) to reassign trust lands among the various beneficiaries, based on information provided by the Commissioner. 

     

    9.      Requires the value of land assigned to each beneficiary to remain substantially equal.

     

    10.  Prohibits the redesignation from having an effect on beneficiaries, lessees or others who hold rights to the land.

     

    Process to reassign lands among beneficiaries

     

    11.  Allows, on application by any qualified person, the Commissioner to initiate the process to reassign trust land among the beneficiaries.

     

    12.  Stipulates that the fair market value of the land to be reassigned must be determined to be of substantially equal value.

     

    13.  Requires the Commissioner to:

    a)      analyze the development and income potential of all land subject to the application;

    b)      consider the proximity of the land to roads, highways and infrastructure;

    c)      consider water rights, mineral rights and other property or contractual rights that may run with the land; and

    d)     consider current land uses, leases, annual lease income, current and potential zoning, site benefits and constraints including topography and drainage issues.

     

    14.  Requires all costs related to the reassignment to be borne by the applicant or from monies appropriated by the Legislature.  Costs may be required to be paid in advance.  Allows the Commissioner to acquire professional services to develop and evaluate the proposal.

     

    15.  Requires the Commissioner to submit a report to the Board and allows the Board to approve the reassignment if it finds the lands to be reassigned are of substantially equal value and the reassignment will benefit all affected beneficiaries.

     

    Miscellaneous

     

    16.  Conditions the enactment of this legislation on amendments to the Arizona Constitution and the Arizona-New Mexico Enabling Act. The Arizona Constitution must be amended at the next general election in November, 2010 and the Enabling Act must be amended by December 31, 2012.

     

    17.  Contains conforming changes.

     

    18.  Becomes effective on the general effective date or later, subject to the provisions of the conditional enactment.

    Amending title 37, chapter 2, article 9, Arizona Revised Statutes, by adding section 37-445; relating to veterans' cemeteries; providing for conditional enactment.

    Be it enacted by the Legislature of the State of Arizona:

    Section 1.  Title 37, chapter 2, article 9, Arizona Revised Statutes, is amended by adding section 37-445, to read:

    START_STATUTE37-445.  Use of trust lands for veterans' cemeteries

    The commissioner shall make available to the department of veterans' services parcels of trust land of up to two hundred fifty acres each for lease as veterans' cemeteries.  The parcels must be located in selected urbanized areas chosen by the department of veterans' services according to need.  The department of veterans' services shall establish and operate the cemeteries pursuant to section 41-603, subsection C, paragraph 2. END_STATUTE

    Sec. 2.  Legislative finding

    As trustee of lands granted to this state for the purposes enumerated in the Arizona-New Mexico Enabling Act (Act of June 20, 1910; 36 Stat. 557), the legislature finds that the lease of trust lands for veterans' cemeteries is consistent with the several objects for which the lands were granted and is an appropriate fiduciary act.

    Sec. 3.  Conditional enactment

    This act does not become effective unless the Constitution of Arizona is amended by vote of the people at the next general election to provide for the leasing or other disposition of lands for use as veterans’ cemeteries.
